Changes include placing Integrated Care Systems (ICSs) on statutory footing, expanding the Secretary of State\u2019s powers over the health service, changes to social care funding, and changes to the tendering and procurement of services.\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EThe Act includes the powers to make changes to NHS Digital (which was formally known as the Health and Social Care Information Centre). These powers enabled the Government to make regulations to transfer NHS Digital\u2019s functions to NHS England. Along with NHSX, NHS Digital\u2019s functions and responsibilities were transferred to NHS England in February 2023. This means that NHS England now holds responsibility for all data and digital services in the NHS, including collecting, analysing and disseminating patient data. This move follows a recommendation from the \u2018Laura Wade-Gery review\u2019 in 2021 and aims to reduce complexity and bring health data expertise closer to decision-making and service delivery.\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003EThe Act includes provisions for increasing integration between health services and adult social care, including to improve the collection, quality and flow of data between health and social care services. It also enables the Health Secretary to direct NHS England to obtain data from adult social care services regarding their activities and service users. This is important as it enables NHS England and ICSs to get a full picture of the health and care needs of the population and understand how social care services impact the NHS and vice versa. This builds on changes in the Cities and Local Government Devolution Act 2016 which made changes meaning that for the purposes of regulation and legislation \u2018patient information\u2019 includes information about social care service users.\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/span\u003E\u003C\/p\u003E\n\u003Cp\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003E\u003Cspan\u003ESection 101 of the Act makes changes to the Medicines and Medical Devices Act 2021 to enable the creation of new information systems for collecting, storing and analysing data on the prescription of medicines \u2013 in essence, enabling the creation medicines registries. These powers would be used where there is a need to minimise known risks associated with a medicine, or where there is uncertainty about the safety of effectiveness of a medicine.
